Injured in Florida? We Will Fight for Your Right to Compensation
In a state as large and dense as Florida, the third most populous in the U.S., it may come as little surprise that the personal injury rate is high here as well.
Still, the numbers are alarming. Accidental injuries are the number one cause of death among Florida residents under the age of 44 and the fourth leading cause of death overall.
In the year 2018 alone, injuries claimed 17,654 lives, which added up to about 8.6% of all resident deaths statewide.
If you or someone you love is wrongfully injured by the negligent behavior of someone else, you deserve to receive prompt, quality medical care and the funds to cover it. Often the best way to secure the amount of fair and just compensation you are entitled to is to work with an attorney.
At Samuel M. Yaffa P.A., our Delray Beach personal injury lawyer is a compassionate and dedicated advocate with decades of experience obtaining injured client’s settlements that cover all their accident-related expenses—and we can help you, too!

What is Personal Injury Law?
When an individual is injured at no fault of their own due to the negligent or careless behavior of another party, personal injury law allows the victim (also known as the “plaintiff”) to bring a lawsuit against the liable party (the “defendant”) for damages.
What Are Damages?
Damages encompass any losses suffered by the plaintiff, such as wages they were not able to receive due to having to take time off work for recovery. Either the defendant or the defendant’s insurance company, depending on the claim, is responsible for paying these damages to the plaintiff.
How Do You Prove Negligence?
The crux of a personal injury claim is negligence. A plaintiff (or their lawyer) must be able to prove that the defendant caused the accident/injury by behaving in a careless manner or by failing to act in a way that a person typically would under similar circumstances.

Do I need to hire a lawyer for a personal injury case?Whether or not you should hire a lawyer depends largely on two factors: the extent of the damages and your personal preference. If you were in a minor accident that resulted in minor injuries and it is clear who is at fault, you can probably handle the claim on your own. If you have suffered serious injuries, the liable party is being uncooperative and denying fault, and/or other factors are making the case more complex than you feel capable of handling on your own, hiring an attorney is likely a good call. However, ultimately the choice is yours. We recommend at least consulting with a lawyer—or even a few—before making your final decision.
-
How often do personal injury claims go to court? Not very. Most personal injury claims are settled with negotiations and never see the inside of a courtroom. Only about 5% of personal injury cases in the U.S. make it to trial. However, we always prepare our cases for trial just in case.
-
What is the personal injury statute of limitations in Florida? In Florida, the deadline to file a personal injury claim (also known as the statute of limitations) is four (4) years.
